(Sumter, SC) -- The family of a child thrown to the floor by a daycare worker in Sumter is suing the facility.
Video of the incident that surfaced in August shows Tiana McElveen throwing the student to the ground twice.
The family of the five-year-old is asking the court for damages to the tune of 35-million dollars against the Care-A-Lot Daycare Center.
The lawsuit says the child hit by McElveen has autism.
